This Terms of Service (“Agreement”) is a legally binding agreement between Pit Boss Shirt Club, a division of Cannon Blue Enterprises Inc. (“Pit Boss Shirt Club,” “PBSC,” “we,” “us,” or “our”), and the person or entity (“you” or “your”) that subscribes to our service, accesses our website, or uses any features or functionality available through www.PitBossShirtClub.com (collectively, the “Pit Boss Shirt Club”).

By accessing the PBSC website and/or subscribing to Pit Boss Shirt Club, you agree to be bound by this Agreement and our Privacy Policy. You must be at least 18 years old to subscribe. If you do not agree with any part of this Agreement, your sole option is not to use or subscribe to Pit Boss Shirt Club.

Joining Pit Boss Shirt Club; Maintaining Membership

Certain features of the PBSC website are available without joining, but purchasing and receiving monthly shirts requires a paid subscription.

When joining, you agree to provide accurate and complete information, including your legal name, billing address, shipping address, email, phone number, and payment information. You represent that you are authorized to use the payment method provided.

You are responsible for:

  • Keeping your account login credentials confidential
  • Updating your contact and payment details
  • Ensuring your billing and shipping information is accurate and current
  • Promptly reporting any loss, theft, or unauthorized use of your payment method

PBSC is not responsible for any losses due to your failure to maintain accurate account information or protect your login details.

Terms of Sale

By joining PBSC, you agree to purchase the “shirt of the month” each month until you cancel your subscription.

  • Auto-Renewal: Your subscription will automatically renew each month, and your payment method will be charged the subscription price plus any applicable taxes and shipping.
  • Cancellations: You may cancel anytime before your next billing date via your account’s “Subscriptions” section. Cancellations made after billing has begun will apply to the following month.
  • Refunds: All payments are final once processed. We may, at our sole discretion, reverse a charge if fulfillment has not yet begun.
  • Shipping & Risk of Loss: Shirts are shipped to the address on file. Risk of loss transfers when the shirt is delivered to the carrier. We may choose to replace lost items at our discretion.
  • Exchanges: First-time members may exchange their first shirt for a different size if unworn and unwashed. Designs are produced in limited runs and may not be replaceable with the same design.
  • Defects: We will replace any shirt with a manufacturing defect when possible; if not possible, we will refund the value of one month’s subscription.

  • Discounts: Offer valid for new Pit Boss Shirt Club customers on auto-renewing subscription plans. Standard subscription pricing applies unless otherwise stated. Subscription renews on the 5th of each month unless canceled. Members may cancel anytime. Offer applies only to subscription purchases and excludes gift cards, add-ons, and past orders. Promotions, discounts, and coupon codes cannot be combined under any circumstances. No cash value. Void where prohibited. PBSC may modify or end any promotion at any time. See pitbossshirtclub.com/terms for full details.

Cancellation of Membership

You may cancel your membership anytime through the Member Login at www.PitBossShirtClub.com. If cancellation occurs after billing has started, it will take effect in the next cycle. Once cancelled, no further shirts will be shipped unless already billed and in fulfillment.

License to Use Website

PBSC grants you a limited, personal, non-transferable, revocable license to use our website for personal, non-commercial purposes in compliance with this Agreement and applicable laws. All rights not expressly granted are reserved by PBSC.

Changes to This Agreement

PBSC may update this Agreement at any time by posting changes on our website or notifying you via your account email. Continued membership or use of our website after changes are posted constitutes your acceptance of the updated terms.

Intellectual Property

All content on the PBSC website, including designs, logos, and graphics, is owned by or licensed to PBSC and protected under copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written consent.

Privacy

Your privacy matters to us. Please review our Privacy Policy, which is incorporated into this Agreement. By using PBSC, you consent to the collection and use of your information as described in our Privacy Policy.

Disclaimers & Limitations of Liability

PBSC is provided “as is” without warranties of any kind, except where prohibited by law.
To the fullest extent permitted by law:

  • PBSC is not liable for indirect, incidental, or consequential damages.
  • Our total liability will not exceed the amount paid by you in the 90 days before the claim arose.

Governing Law & Arbitration

This Agreement is governed by the laws of the State of Florida, USA. Disputes will be resolved through binding arbitration in Miami, Florida, except where prohibited or as otherwise outlined in this Agreement.

Miscellaneous

This Agreement is the complete understanding between you and PBSC. If any provision is found unenforceable, the remaining terms remain in effect. Section headings are for convenience only.

Statute of Limitations

Any claim related to this Agreement must be filed within one (1) year of when it arose or it will be permanently barred.

 

Mobile Terms of Service

Pit Boss Shirt Club

The Pit Boss Shirt Club mobile message service (the "Service") is operated by Pit Boss Shirt Club (“Pit Boss Shirt Club”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Pit Boss Shirt Club’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Pit Boss Shirt Club through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Pit Boss Shirt Club. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18775485518 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Pit Boss Shirt Club mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
